1. Introduction
These Terms & Conditions (“Terms”) govern your access to and use of the Arbitalk platform, available at https://arbitalk.com . By accessing or using the platform, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws. If you do not agree, you must discontinue use of the platform immediately. The terms “we,” “us,” “our,” or “Arbitalk” refer to the platform, and “you” or “user” refers to any person or entity accessing or using the platform.
2. Eligibility
You must be at least eighteen years of age and legally competent to contract under the Indian Contract Act, 1872, in order to use Arbitalk. By using the platform, you represent and warrant that you meet these eligibility requirements.
3. Services Provided
Arbitalk is a digital-first dispute resolution platform created to help micro, small, and medium enterprises (MSMEs) and other businesses resolve disputes quickly, affordably, and effectively. The services offered include online case submission and document upload, drafting and sending of notices to counterparties, appointment of neutrals such as mediators, conciliators, or arbitrators from Arbitalk’s verified panel, conduct of online hearings via secure video conferencing, and issuance of settlement agreements or arbitral awards as applicable. In addition, Arbitalk may provide AI-assisted drafting tools, automated reminders, and customer support to assist in the resolution process.
4. User Responsibilities
You agree to provide accurate, complete, and updated information when using the platform and to maintain the confidentiality of your account credentials. You are responsible for all activities conducted under your account. You must not misuse the platform, attempt to gain unauthorized access, or engage in activities that could harm the platform or its users. You further agree not to upload, share, or submit content that is unlawful, defamatory, offensive, fraudulent, or in violation of intellectual property or privacy rights.
5. Payment and Fees
Arbitalk charges service fees depending on the nature and value of disputes. All fees are communicated transparently before initiating proceedings. Payments are processed through secure third-party gateways, and Arbitalk does not store sensitive payment details such as card numbers or banking information. Once services have been initiated, payments are non-refundable except where required by law.
6. Use of Neutrals
Arbitalk appoints mediators, conciliators, and arbitrators from its verified panel depending on the nature of the dispute. These neutrals are independent professionals and not employees of Arbitalk. Arbitalk does not guarantee specific results and is not liable for the decisions, awards, or settlements issued by appointed neutrals.
7. Limitation of Liability
Arbitalk is a technology platform that facilitates dispute resolution. While we strive to ensure effective and efficient services, we do not guarantee any particular outcome. To the fullest extent permitted by law, Arbitalk shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the platform, reliance on its services, or inability to access or use the platform.
8. Intellectual Property
All content, trademarks, logos, designs, text, graphics, and software on the Arbitalk platform are the intellectual property of Arbitalk or its licensors. You may not copy, modify, distribute, reproduce, or exploit any part of the platform without prior written consent.
9. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms or relating to the platform shall be subject to the exclusive jurisdiction of the courts in Surat, Gujarat, India.
10. Amendments
Arbitalk reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the platform after such modifications constitutes acceptance of the updated Terms.
